Our sales are subject to these general terms and conditions, which supersede any other stipulations originating from the buyer. Any order placed by the buyer implies their full and unreserved acceptance of these general terms and conditions of sale.

Orders

Orders placed through the website are binding on the buyer upon acceptance of the order by the buyer on the website.
The information, photos, and graphics in the catalogs are for illustrative purposes only and are not binding on the merchant.
From the moment the customer registers their order, they are considered to have knowingly and unreservedly accepted the prices, volumes, and quantities offered for sale and ordered.

Price

Prices are always expressed in euros, excluding VAT and delivery charges. The applicable VAT rate is 20%. Product prices are those in effect at the time the order is placed, excluding shipping costs.
Product prices may be changed at any time due to external events.
Shipping costs are the responsibility of the customer and are charged in addition to the product price, depending on the order amount.
Shipping costs will be displayed when the customer places the order.

Payment

Unless otherwise specified, products are payable upon ordering and without discount. Any sum paid by the customer prior to delivery of the product constitutes a deposit on the final sale price owed by the customer.

Despite cash payment and in accordance with the Law on the Modernization of the Economy No. 2008-776 of August 4, 2008, any delay in payment will automatically result in the application of a penalty equal to the interest rate applied by the ECB to its most recent refinancing operation plus 10 percentage points, payable from the first day of delay.

Furthermore, in accordance with Decree No. 2012-1115 of October 2, 2012, any delay in payment by the customer automatically results in the application of a fixed compensation of forty (40) Euros, without prejudice to the late payment penalties provided for in the preceding paragraph.

Failure to pay by the due date makes all debts owed by SHOPSTORE to the customer immediately payable without prior notice.

Right of Withdrawal

For any Purchase made on the Site except for orders of personalized or made-to-measure products or opened products, the Customer has a period of fourteen (14) days from the receipt of the Product(s) ordered to exercise, with SHOPSTORE, his right of return, without having to provide justification or pay any penalty.

Returns must be made in their original condition and complete (packaging, accessories, instructions…) in packaging identical to that used for shipping within fourteen (14) days of exercising this right.

If the right of withdrawal is exercised within the indicated period, the price of the product(s) concerned will be refunded, with the return costs remaining the responsibility of the customer.

SHOPSTORE then proceeds to refund the products as soon as possible and at the latest within fourteen (14) days following the date on which the right was exercised.

After the period of fourteen (14) days, the goods will not be returned or exchanged.

To exercise your right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement sent by post to SHOPSTORE, Rue Edouard Branly, ZI Pied de la Montagne, 69170 TARARE , France, or by email to commercial@shopstore.fr.

Delivery

Products are delivered within three (3) to five (5) days from shipment (learn more about delivery costs) .

The carrier is authorized by Shopstore to leave packages at the entrance of the store or building, and no deliveries will be made to upper floors. Shopstore reserves the right to split deliveries if one or more items are unavailable. If the delivery timeframe is exceeded, as indicated to the customer by email, the customer will have the option to cancel their order or wait without penalty. Delivery is considered complete upon the product being made available to the customer. It is the customer's responsibility to check the condition of the delivered goods in the presence of the carrier and to make any reservations or claims that appear justified.
If the delivered products do not conform in nature or quality to the specifications indicated on the delivery note, the customer must, under penalty of forfeiture, submit their claims within eight (8) days of delivery.

Retention of title

The seller retains full ownership of the goods sold until full payment of the price, including principal, fees, and taxes.
The transfer of risk of damage to or loss of the goods will occur upon receipt of the delivered goods.

Guarantees

The products sold are covered by a manufacturer's warranty. Excluded from this warranty are any products modified or repaired by the buyer or any other person not expressly authorized by the seller, as well as any products subject to a specific support and maintenance contract.
Any return of a product under the aforementioned warranty must be approved in advance by the seller. To this end, the buyer must contact the seller's after-sales service by submitting their request via email. If the product is deemed defective, the seller will provide the buyer with a return authorization number. The defective product must be returned in its original packaging and accompanied by the return authorization number provided by the seller. All costs and risks associated with the return of the product are the responsibility of the buyer.

Responsibility

The seller shall not be held liable in any way for any indirect damages. In the event of direct damages, the seller's liability is limited to a maximum of 520 euros.

Jurisdiction allocation

These general terms and conditions of sale are governed by French law. For all disputes relating to this contract between the seller and the buyer, the Commercial Court of Villefranche-sur-Saône/Tarare shall have sole jurisdiction.

Data Processing and Freedoms

In accordance with the French Data Protection Act of 6 January 1978, the Customer has the right to access and rectify data concerning him/her and kept by the merchant.
